FollowUp Pal Terms of Service

Who provides the service

AVFA LLC · EIN 32-0841742contact@axxonmedia.com

FollowUp Pal is operated by this company, registered in the United States. Our order process is conducted by Paddle, our official reseller and the Merchant of Record for all our orders. Paddle processes the order, issues the receipt, is responsible for billing the customer, and handles applicable taxes (VAT, sales tax).

1. What FollowUp Pal is

FollowUp Pal is browser-based subscription software (SaaS). After the subscriber connects their own WhatsApp number, the service tracks conversations on that number and identifies contacts who received a message from it and never replied. Those conversations appear in a pending list, showing how many days have passed since the last attempt.

For each pending item, the service suggests a follow-up message generated by artificial intelligence, based on the history of that conversation. The suggestion is always a draft: no message is sent without the subscriber reading it, editing it if they wish, and approving it. FollowUp Pal is not a bulk messaging tool and does not send campaigns.

The service depends on an active connection to the subscriber's WhatsApp and on third-party services (cloud infrastructure, a WhatsApp connection provider, and an AI model provider). We do not promise uninterrupted availability or business results: FollowUp Pal organizes follow-up, it does not guarantee a reply or a sale.

2. How to subscribe

Sign-up happens on the site itself, with email and password (or a Google account), and no credit card is required. Every account starts on the Free plan, which is permanent: it has no expiry date and never turns into a charge on its own. To raise the limits, the subscriber picks a paid plan and pays the first monthly fee at checkout.

The available payment methods are shown at checkout and vary by country. The order is processed by Paddle, acting as our official reseller and Merchant of Record: Paddle charges the subscriber, issues the receipt, and collects applicable taxes (VAT, sales tax). FollowUp Pal never receives or stores the subscriber's payment details.

If a paid plan ends (by cancellation or by non-payment), the account returns to the Free plan at the end of the period already paid for, with the Free plan limits. Access is never suspended for non-payment. Data can be deleted upon request.

3. Plans, prices and limits

The available plans and the actual limits of each one are:

  • Free — $0, permanent. 1 connected WhatsApp number, up to 50 monitored contacts, up to 50 AI drafts in total (not per month), and a daily summary of pending items.
  • Solo — $19 per month (R$ 97). 1 connected WhatsApp number, up to 300 monitored contacts, up to 300 AI drafts per month, and a daily summary of pending items.
  • Pro — $39 per month (R$ 197). 1 connected WhatsApp number, unlimited monitored contacts, unlimited AI drafts, control via WhatsApp itself, and a reply report.
  • Team — $79 per month (R$ 397). Up to 3 connected WhatsApp numbers, everything in the Pro plan, a team dashboard, and per-salesperson reporting.

When a plan limit is reached (contacts, drafts, or connected numbers), the corresponding feature pauses until the next billing cycle or until the plan is upgraded. The subscriber can change plans at any time from the dashboard; the difference is adjusted in the following cycle. Prices may change, and any change is announced by email at least 30 days in advance, applying only to renewals after the notice.

A Free plan account with no sign-in for 30 days has its WhatsApp connection closed to free up the resource. The subscriber is warned by email before the connection is closed. Nothing is deleted: contacts, follow-ups and history remain available, and coming back only requires reconnecting WhatsApp by scanning the QR code again. Paid accounts are never disconnected for inactivity.

4. Billing and renewal

The subscription is monthly and renews automatically at the end of each 30-day period, on the same plan and with the same payment method, until the subscriber cancels. There is no minimum term or cancellation fee.

Depending on the payment method chosen at checkout, billing may be recurring and automatic or generate a new charge each cycle, with advance notice to pay; access continues as long as the cycle's payment is current.

If a payment fails or is not made, the account becomes past due and access is suspended once the already-paid period ends. Once payment is settled, access is restored with the data preserved.

5. Cancellation

Cancellation is done from the dashboard, in the account area, in two clicks, with no need to speak to anyone. No justification or waiting for support is required.

Upon cancellation, automatic renewal stops, but access remains available until the end of the period already paid for. After that, the account is deactivated and the WhatsApp connection is closed.

6. Refund policy

The subscriber may request a full refund of the first charge within 14 calendar days from the date of that payment, for any reason. Just write to contact@axxonmedia.com from the registered email address, or contact Paddle directly at paddle.net — Paddle is our official reseller and the Merchant of Record for our orders. The refund is processed by Paddle within 10 business days, through the same payment method used for the purchase.

Passed the 14 days from the first charge, monthly fees already paid are not refunded; cancellation only stops future charges, with access maintained until the end of the paid period. Charges made due to our error are refunded in full, at any time.

7. WhatsApp connection and risks

The connection is made by scanning a QR code, using the WhatsApp Web protocol — the same mechanism as WhatsApp on a computer. The connected number belongs to the subscriber and remains under their control: disconnection can be done at any time with one click on the dashboard, and monitoring stops immediately.

Honest disclosure: FollowUp Pal has no affiliation with WhatsApp or Meta Platforms, Inc., and is not an official WhatsApp Business API partner. WhatsApp may restrict, limit, or ban numbers that show an automated usage pattern, even when messages are approved one by one. This risk exists and belongs to the number's owner. By connecting WhatsApp, the subscriber acknowledges this and accepts the risk. We are not liable for any block, restriction, or loss of access to the number imposed by WhatsApp.

To reduce this risk, the service never sends messages without approval, never sends bulk blasts, and respects the time window defined by the subscriber.

8. Subscriber responsibilities

The subscriber is the controller of their contacts' data and represents that they have a lawful basis to process it, under the GDPR, LGPD, or the law applicable in their country. FollowUp Pal acts as a processor of that data, handling it only to provide the contracted service.

It is prohibited to use the service for bulk messaging, spam, messages to anyone who asked not to be contacted, illegal, deceptive, or offensive content, or content that violates WhatsApp's terms. It is also prohibited to share the account with third parties beyond the plan's limits or attempt to circumvent the product's technical limits.

Violations may lead to immediate suspension of the account, without a refund of monthly fees already used.

9. Data and privacy

Message content is encrypted in transit and at rest, restricted to the subscriber's account, and retained for a maximum of 90 days, after which it is automatically deleted. Our team does not read conversations; human access only happens if the subscriber requests support and explicitly authorizes it. Details are in the Privacy Policy.

10. Limitation of liability

The service is provided as is. We do our best to keep it available and accurate, but we do not guarantee operation free of failures or interruptions, nor the accuracy of AI-generated texts — which must be reviewed by the subscriber before sending.

To the maximum extent permitted by law, we are not liable for lost profits, lost business opportunities, data loss caused by third parties, or indirect damages. Should we be found liable, it is limited to the amount paid by the subscriber in the 12 months preceding the event.

11. Changes, governing law and venue

These terms may be updated. Material changes are announced by email at least 30 days in advance, and continuing to use the service afterward means agreeing to the new version.

AVFA LLC is registered in the state of Wyoming, United States. These terms are governed by the laws of the State of Delaware, United States, without prejudice to the consumer rights provided under the law of the subscriber's country of residence — including Brazil's Consumer Defense Code, for subscribers in Brazil. Brazilian consumers may sue in the court of their own domicile.
